The shipper may, at any time and without any restrictions, make his booked capacities available to a third party for use or transfer his contractual rights and obligations to a third party.
In the event that booked capacities are made available to a third party, the shipper will remain party to the contract concluded with Open Grid Europe and therefore continue to hold his contractual rights and obligations.
In the case of a transfer of rights and obligations, which is subject to Open Grid Europe approval, the shipper will cease to be the holder of the rights and obligations transferred. Open Grid Europe will not refuse its approval except for good cause.
For secondary capacity marketing the shipper may use, in particular, the European Capacity Platform PRISMA.
